By accessing or using our Site, placing an order, or booking a service, you confirm that you have read, understood, and agreed to be bound by these Terms in full. 01 · AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement between you — whether personally or on behalf of an entity (“you”) — and Inglass Nails™ (“Inglass Nails,” “we,” “us,” or “our”), governing your access to and use of inglassnails.com and any related media, channels, or applications (collectively, the “Site”).

By accessing the Site, placing an order, or booking any service, you confirm that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you must discontinue use of the Site immediately.

We reserve the right to modify these Terms at any time. Changes are effective upon posting, indicated by an updated “Last Updated” date. Your continued use of the Site after any change constitutes acceptance of the revised Terms. Please review this page periodically.

The Site is intended for users who are at least 13 years of age. Minors under 18 must have parental permission and supervision to use the Site. The Site is hosted in the United States and is not tailored to comply with industry-specific regulations such as HIPAA or FISMA. Do not use the Site in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

The information on this Site is not intended for distribution to persons in jurisdictions where such distribution would be contrary to applicable law. Those who access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws.

02 · INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and all of its content — including source code, databases, software, designs, audio, video, text, photographs, graphics, and nail art imagery — as well as all trademarks, service marks, and logos (collectively, the “Marks”) are the proprietary property of Inglass Nails™ and are protected under United States and international copyright, trademark, and intellectual property law.

Inglass Nails™, Bond-on Hard Gel Extensions™, Bond-on Hard Gel Nail Extensions™, Bond-on Nail Extensions™, The Inglass Nails Virtual Sculpting Kit™, The Inglass Nails Renewal™ and Bond-on Toenail Extensions™ are proprietary brand names and terms belonging exclusively to Inglass Nails. Unauthorized use of these names, terms, or any confusingly similar variation — in any medium, platform, or commercial context — constitutes trademark infringement and will be pursued accordingly.

You are granted a limited, non-commercial license to access and use the Site and download or print content solely for personal use. No content or marks may be copied, reproduced, republished, sold, licensed, or commercially exploited without our express prior written permission. All rights not expressly granted are reserved.

Our proprietary sculpting process, bonding system, kit design, written application guides, and all branded content are protected intellectual property. Accessing this Site as a nail technician, beauty professional, or industry competitor for the purpose of replicating, studying, or commercially reproducing any aspect of our products, processes, or content is expressly prohibited and constitutes a violation of these Terms.

03 · OUR SERVICES & PRODUCTS

Inglass Nails™ operates as a virtual nail salon offering Bond-on Hard Gel Extensions™ — handcrafted, made-to-order nail extension sets sculpted entirely to each client’s individual nail bed measurements. All nail extension sets are custom products made on demand and are not mass-produced or pre-made.

Our products, services, processes, and content are intended exclusively for personal client use. Accessing this Site with the intent to study, replicate, reproduce, or commercially exploit our proprietary sculpting methods, bonding system, product construction, or branded content — whether as a nail technician, beauty professional, or industry competitor — is expressly prohibited and constitutes a violation of these Terms and applicable intellectual property law.

We reserve the right to refuse service to any person at any time and for any reason, including but not limited to suspected professional or trade use, suspected intent to copy or replicate our proprietary methods, or any violation of these Terms.

By placing an order, you represent that you are purchasing exclusively for personal wear and not for professional, trade, or commercial purposes of any kind.

All product descriptions, pricing, images, and availability are subject to change without notice at our sole discretion. We make every effort to display colors and product details accurately, but we cannot guarantee that your device’s display will be fully accurate. Slight variations inherent in handmade products do not constitute defects.

We reserve the right to limit quantities, discontinue products, or restrict orders to any person, geographic region, or jurisdiction on a case-by-case basis.

04 · VIRTUAL SCULPTING KIT POLICY

The Inglass Nails Virtual Sculpting Kit carries a retail value of $50 and is provided complimentary to all first-time nail extension clients. This offer applies to the initial kit only and is subject to the conditions outlined below.

Kit Return — Unused Condition

If you change your mind after receiving your kit and wish to cancel your order, the kit must be returned unused and unopened using the prepaid USPS return label included in your package. Upon receipt and inspection of the returned kit in unused condition, a refund will be issued for the cost of your nail set minus both outbound and return shipping label fees.

Kit Returned in Used Condition

If your order is cancelled and the kit is returned in used or opened condition, the following fees will be charged prior to or deducted from any refund:

— $50 kit fee, reflecting the retail value of the used kit

Used kits are not eligible for a fee waiver under any circumstance. To avoid these charges, the kit must be returned unused and unopened.

Unusable or Damaged Impressions

If we receive your impressions and determine they are unusable or damaged, we will contact you promptly. You will be presented with two options:

Option A — Proceed with a New Kit

We will send you a replacement kit so you may redo your impressions. Because the first kit was received and used, a shipping fee for both the outbound and return labels will be charged for the replacement kit. The $50 kit fee is waived for the replacement — you are responsible for shipping costs only. Your Creation Date will be rescheduled to the next available date following receipt of your corrected impressions.

Option B — Cancel Your Order

If you prefer not to proceed, you may cancel your order. A refund will be issued for the cost of your nail set minus the $50 kit fee — as the kit was received, opened, and used. This refund will be processed promptly upon your confirmation.

We strongly encourage watching the full video guide before beginning your impressions. Detailed instructions are printed inside the box and available at inglassnails.com. Proper preparation is the single most effective way to ensure usable results on the first attempt.

Kit Shipping & Loss in Transit

Your kit ships via USPS the next business day after purchase. If your kit has shown no tracking movement for more than two weeks, please contact our client care team. After confirming the package is lost in transit, we will reship your kit at no additional cost.

If your return kit — containing your impressions — is lost in transit on the way back to us, we will reship a new kit at no additional cost and reschedule your Creation Date accordingly. Inglass Nails is not responsible for carrier delays that do not qualify as a lost package.

05 · BOOKING, ORDERS & CANCELLATIONS

First-Time Orders

First-time clients must select a Creation Date at least 3 weeks from the date of purchase to allow time for the Virtual Sculpting Kit to reach you, your impressions to be completed and returned, and for us to receive them. Creation Dates cannot be guaranteed until impressions are received. If impressions arrive after your selected Creation Date, your booking will be rescheduled to the next available date.

Returning Clients

Once your impressions are on file, you may book any future sets on whichever Creation Date is available. Your extensions will be handcrafted on your Creation Date and shipped the next business day.

Order Changes

Once an order is placed, we are unable to modify it. However, changes to nail art details, shape, length, or color may be accommodated provided they do not result in additional charges or require a different Creation Date. Such requests must be submitted at least 24 hours before your booked slot. We are not able to accommodate shape changes that disrupt the structural foundation of the extension, or length extensions that require full sculpting from scratch.

Cancellation Policy

Custom nail art bookings: Cancellations are permitted up to 72 hours before your scheduled creation date for custom nail art bookings, but a $30 custom nail art consultation fee will apply.

All other nail extension bookings: Cancellations are accepted up to 72 hours before your scheduled Creation Date. Cancellations after this window will not be accepted. No cancellation fees are charged. Cancelling more than 2 bookings within a 12-month period may result in denial of future services at our discretion.

Non-nail extension items: Orders may be cancelled within 12 hours of purchase. Requests after this window will not be accepted.

We reserve the right to cancel or adjust any order at our discretion if we determine it may violate these Terms, with or without prior notice.

Accuracy of Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information for all orders. We reserve the right to refuse, limit, or cancel orders that appear to be placed by dealers, resellers, distributors, or trade professionals. We may limit quantities purchased per person, household, or order at our discretion.

06 · RETURNS, REFUNDS & EXCHANGES

Every Inglass Nails set is handcrafted from scratch on your Creation Date — made exclusively for your nail beds and no one else’s. Because every set is a one-of-a-kind service created specifically for you, all nail extension sales are final. We do not accept returns or exchanges. Returned or refused packages are not eligible for a refund.

Damaged or Incorrect Items

If there is an issue with your order upon arrival, contact us within 3 calendar days of the delivery date via email with a brief description and photo of the issue. Issues eligible for resolution include manufacturing defects and damage incurred during shipping. Cosmetic variations inherent to handmade products — including minor finish differences, slight color variation from screen display, or natural inconsistencies in nail art — do not constitute defects.

Non-Nail Extension Products

All other products may be returned in their original condition — unopened and unused — within 30 days of receipt. Return shipping costs are the customer’s responsibility. We are not liable for lost or damaged return packages. Refunds are processed upon receipt and inspection.

07 · SHIPPING & DELIVERY

Inglass Nails ships exclusively within the contiguous United States, Alaska, and Hawaii. We do not ship internationally, to Puerto Rico, or to P.O. Boxes.

The Virtual Sculpting Kit ships via USPS. All nail extension sets ship via UPS for the 48 contiguous states, and USPS Priority Mail for Alaska and Hawaii.

Free standard shipping is available on orders over $55 within the 48 contiguous states. Orders below $55 are subject to a $6.99 shipping fee. UPS Next Day Air is available at checkout for eligible orders. For orders to Alaska and Hawaii, USPS Priority Mail Express is also available.

For orders exceeding $400, a signature upon delivery may be required at our discretion. You will be notified prior to shipment if this applies.

Once your order has been handed to the carrier, shipping and handling are outside of our control. Carrier delays do not constitute grounds for cancellation, penalty, or compensation. Inglass Nails is not liable for delays caused during transit, including delays during peak periods and holidays.

Inglass Nails is not responsible for packages marked as delivered to the address provided at checkout. Please double-check your shipping address before completing your order. We are not responsible for orders delivered to an incorrectly entered address. If your order is still in transit, you may contact the carrier directly to request an address change — the carrier may charge a fee for this service.

Lost package claims must be reported after two weeks of no tracking movement. Approved claims are processed as product replacements only — no refunds or store credit will be issued. Replacements may require a signature upon delivery.

08 · USER REPRESENTATIONS

By using the Site, you represent and warrant that:

1. All registration information you submit is true, accurate, current, and complete.

2. You will maintain the accuracy of your information and promptly update it as necessary.

3. You have the legal capacity and agree to comply with these Terms.

4. You are not under the age of 13.

5. If you are a minor, you have received parental permission to use the Site.

6. You will not access the Site through automated or non-human means.

7. You will not use the Site for any illegal or unauthorized purpose.

8. You are purchasing exclusively for personal use and not for professional, trade, or commercial purposes.

9. You are not a nail technician, beauty industry professional, or competitor accessing the Site to study, replicate, or commercially reproduce our products or processes.

If any information you provide is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and refuse current or future use of the Site.

09 · PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make it available. As a user, you agree not to:

1. Access the Site as a nail technician, beauty professional, or industry competitor for the purpose of studying, replicating, or commercially reproducing our products, processes, bonding systems, or sculpting methods.

2. Systematically retrieve data or content from the Site to compile a database or directory without written permission.

3. Trick, defraud, or mislead us or other users, including any attempt to learn sensitive account information.

4. Circumvent, disable, or interfere with security-related features of the Site.

5. Disparage, tarnish, or otherwise harm us or the Site.

6. Use the Site in a manner inconsistent with any applicable laws or regulations.

7. Upload or transmit viruses, malware, or other harmful material.

8. Engage in any automated use of the system, including scripts, bots, or data mining tools.

9. Attempt to impersonate another user, person, or entity.

10. Delete or alter any copyright or proprietary rights notices from any content.

11. Harass, intimidate, or threaten any of our employees or agents.

12. Copy or adapt the Site’s software or code without authorization.

13. Use the Site as part of any effort to compete with us or for any revenue-generating or commercial enterprise.

14. Use a buying agent or purchasing agent to make purchases on the Site.

15. Sell or otherwise transfer your profile or account.

16. Post false reports of abuse, submit false claims, or make improper use of our support services.

10 · USER CONTRIBUTIONS & REVIEWS

If we provide areas for you to submit content, reviews, or feedback, any content you submit must comply with the following: it must be based on genuine firsthand experience; it must not contain offensive, discriminatory, or abusive language; it must not contain false or misleading statements; and it must not be submitted as part of an organized campaign to manipulate ratings.

We reserve the right to accept, reject, or remove any review or submission at our sole discretion without obligation. Reviews do not represent the views of Inglass Nails and we assume no liability for their content.

By submitting feedback or suggestions regarding the Site, you agree that we may use such feedback for any purpose without compensation to you. You retain ownership of your original contributions, but grant us a perpetual, non-exclusive, worldwide, royalty-free license to reproduce, modify, display, and distribute content related to reviews.

Any questions, comments, or suggestions you submit to us become our sole property. We own exclusive rights to such submissions and are entitled to unrestricted use without acknowledgment or compensation.

11 · PRIVACY & DATA

We care about data privacy and security. By using the Site, you agree to be bound by our Privacy Policy, available at inglassnails.com, which is incorporated into these Terms by reference.

The Site is hosted in the United States. If you access the Site from any region with laws governing personal data collection or use that differ from United States law, your continued use of the Site constitutes consent to the transfer and processing of your data in the United States.

We do not knowingly collect information from children under the age of 13. If we become aware that a child under 13 has provided personal information without verifiable parental consent, we will delete that information promptly.

We maintain data you transmit to the Site for operational purposes. You are solely responsible for all data you transmit or that relates to your activity on the Site. We shall have no liability for any loss or corruption of such data.

You may be required to register with the Site. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. We reserve the right to remove or reclaim any username we deem inappropriate or objectionable.

12 · DISCLAIMERS & LIMITATIONS

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, INGLASS NAILS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE SITE OR ANY LINKED WEBSITES.

We shall not be liable for errors, inaccuracies, or omissions in content; personal injury or property damage resulting from use of the Site; unauthorized access to our servers or personal information; interruptions or cessation of transmission to the Site; bugs, viruses, or other harmful elements transmitted through the Site by third parties; or any loss or damage resulting from use of content posted or transmitted via the Site.

We do not warrant that the quality of any products or services obtained through the Site will meet your expectations. Prices are subject to change without notice. We reserve the right to correct errors in pricing or descriptions at any time, including after an order has been submitted.

We cannot guarantee the Site will be available at all times. We may experience maintenance periods, interruptions, or errors. We have no liability for any loss caused by inability to access the Site during downtime or discontinuance.

We reserve the right to change, modify, suspend, or discontinue the Site or any part of it at any time without notice or liability.

13 · INDEMNIFICATION

You agree to defend, indemnify, and hold Inglass Nails™ harmless — including our officers, agents, partners, and employees — from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, arising out of:

1. Your use of the Site.

2. Breach of these Terms of Service.

3. Any breach of your representations and warranties set forth herein.

4. Your violation of the rights of any third party, including intellectual property rights.

5. Any harmful act toward another user of the Site.

6. Your use of our Site for professional, trade, or commercial purposes in violation of these Terms.

We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense of such claims.

14 · GOVERNING LAW

These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of any remaining provisions. These Terms constitute the entire agreement between you and Inglass Nails regarding use of the Site.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right. We may assign our rights and obligations to others at any time. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Terms.

For California users: if a complaint is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
