01 · OVERVIEW & AGREEMENT TO TERMS

Welcome to Inglass Nails™. The terms "we," "us," and "our" refer to Inglass Nails™. Inglass Nails operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you with a custom virtual nail studio experience (the "Services"). Inglass Nails is powered by Shopify Inc., which enables us to provide the Services to you.

These Terms of Service, together with our Studio Policies, Client Acknowledgment & Release, and Privacy Policy, each available at inglassnails.com and incorporated herein by reference, describe your rights and responsibilities when you use the Services.

By accessing the Site, placing an order, or booking any service, you confirm that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you must discontinue use of the Site immediately. These Terms of Service do not limit any rights you may have under applicable consumer protection laws or other non-waivable statutory rights.

This Site and all Inglass Nails™ services are intended for adults only. We do not provide services to minors under any circumstances, including with parental or guardian permission or supervision. By using this Site or placing an order, you confirm that you are at least 18 years of age. This supersedes any general minimum-age language that may appear in Shopify's standard platform terms, as our services are not appropriate for minors regardless of consent.

The Site is hosted in the United States and is not tailored to comply with industry-specific regulations such as HIPAA or FISMA. Do not use the Site in a way that would violate the Gramm-Leach-Bliley Act (GLBA). The information on this Site is not intended for distribution to persons in jurisdictions where such distribution would be contrary to applicable law.

We reserve the right to modify these Terms at any time. Changes are effective upon posting, indicated by an updated "Last Updated" date. Your continued use of the Site after any change constitutes acceptance of the revised Terms.

02 · ACCESS AND ACCOUNT

To use the Services, you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all account activity. Each client must maintain her own individual account; accounts may not be shared between multiple wearers, as described further in Section 07. You may not transfer, sell, assign, or license your account to any other person.

03 · INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and all of its content — including source code, databases, software, designs, audio, video, text, photographs, graphics, and nail art imagery — as well as all trademarks, service marks, and logos are the proprietary property of Inglass Nails™ and are protected under United States and international copyright, trademark, and intellectual property law.

Inglass Nails™, Bond-on Nails™, Bond-on Hard Gel Nail Extensions™, Bond-on Nail Extensions™, Bond-on Hard Gel Extensions™, The Inglass Nails Virtual Sculpting Kit™, The Inglass Nails Renewal™, and Bond-on Toenail Extensions™ are proprietary brand names and terms belonging exclusively to Inglass Nails. Unauthorized use of these names, terms, or any confusingly similar variation constitutes trademark infringement and will be pursued accordingly.

You are granted a limited, non-commercial license to access and use the Site and download or print content solely for personal use. No content or marks may be copied, reproduced, republished, sold, licensed, or commercially exploited without our express prior written permission. All rights not expressly granted are reserved.

Our proprietary sculpting process, bonding system, kit design, written application guides, and all branded content are protected intellectual property. Accessing this Site as a nail technician, beauty professional, or industry competitor for the purpose of replicating, studying, or commercially reproducing any aspect of our products, processes, or content is expressly prohibited and constitutes a violation of these Terms.

The purchase or delivery of any product does not grant or confer any intellectual property rights in or to the product, its design, or underlying process. Shopify's name, logo, and trademarks belong to Shopify. All other names, logos, and trademarks on the Services belong to their respective owners.

04 · OUR SERVICES & PRODUCTS

Inglass Nails™ operates as a virtual nail studio offering Bond-on Hard Gel Extensions™ — handcrafted, made-to-order nail extension sets sculpted entirely to each client's individual nail bed measurements. All nail extension sets are custom products made on demand and are not mass-produced or pre-made.

We have made every effort to provide an accurate representation of our products in our online store. However, colors or product appearance may differ from how they appear on your screen due to your device and display settings. We do not warrant that the appearance or quality of any product will exactly match its depiction in our store. Slight variations inherent in handmade products do not constitute defects.

Our services are designed exclusively for personal use by the individual placing the order and are not intended for resale, professional study, trade use, or use by nail technicians or beauty industry professionals seeking to replicate our methods. By placing an order, you represent that you are purchasing exclusively for personal wear and not for professional, trade, or commercial purposes.

All product descriptions, pricing, images, and availability are subject to change without notice. We reserve the right to discontinue any product, limit quantities, or restrict orders to any person, geographic region, or jurisdiction, and to refuse service to any person at any time and for any reason, including suspected professional or trade use or any violation of these Terms.

05 · STUDIO CLIENT TIERS & BOOKING ENTRANCES

Inglass Nails™ operates with three client tiers. Each tier has its own booking entrance, calendar access, and experience. Please book through the entrance that corresponds to your client status. Booking through the wrong entrance may result in your order being rescheduled or cancelled.

New to the Studio
First-time clients who have never placed an order with Inglass Nails™. New to the Studio clients receive a complimentary Virtual Sculpting Kit with their first order and must select a Creation Date at least 3 weeks from their purchase date. Once your sizes are on file after your first order, you will transition to Studio Guest status for all future bookings.

Studio Guests
Clients who have completed their first order and have sizes on file, but order occasionally rather than on a regular monthly schedule. Studio Guests book from the guest calendar with no kit wait time. You are a Studio Guest if you order occasionally or if you were previously a Studio Member and have not ordered for 2 consecutive months.

Studio Members
Clients who order every month consistently. Studio Members have access to the priority calendar — Creation Dates with greater availability and earlier booking windows than our general calendar, reserved for regular clients. No separate reservation or fee is required. Studio Member status is maintained by placing at least one order per month. If you do not order for 2 consecutive months, your status returns to Studio Guest. You may regain Studio Member status by placing two consecutive monthly orders.

06 · ORDERS, PRICES & BILLING

When you place an order, you are making an offer to purchase and you authorize us and our payment processor to charge your selected payment method for the total amount of your order. We reserve the right to accept or decline your order for any reason at our discretion, subject to applicable law. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests outside the windows described in Section 09. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact information provided at checkout. Your purchases are subject to return or exchange solely in accordance with Section 13. You represent that your purchases are for your own personal use and not for commercial resale.

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as reflected in your order confirmation email. Posted prices do not include taxes, shipping, or handling unless otherwise stated. You agree to provide current, complete, and accurate payment information, and you represent that you are authorized to use the payment method provided and that charges you incur will be honored.

07 · VIRTUAL SCULPTING KIT POLICY

The Inglass Nails Virtual Sculpting Kit is provided free of charge to first-time clients upon ordering a nail extension set. The kit carries a retail value of $50.

One Client, One Kit, One Account. Each Virtual Sculpting Kit and account is intended for use by a single individual, matched to their own nail bed measurements. Kits and accounts may not be shared between household members. Orders, sizing kits, and accounts may not be purchased, transferred, or gifted for use by another person — services are intended solely for the person who will wear the extensions.

If you change your mind after receiving your kit, you may request a refund of your nail set provided the kit is returned unused and unopened using the prepaid return label. The refunded amount will reflect the cost of your nail set minus both outbound and return shipping label fees.

If the kit is returned in used or opened condition, a $50 kit fee will be charged. Used kits are not eligible for a fee waiver under any circumstance.

If we receive your sizes and determine they are unusable or damaged, we will contact you with two options: a replacement kit at no $50 kit fee but subject to shipping costs, or cancellation of your order with a refund minus the $50 kit fee. If a second replacement kit also proves unusable, we will generally offer a full refund minus the $50 kit fee rather than issuing further replacements.

If your kit shows no tracking movement for more than 2 weeks, contact client care and we will reship at no additional cost. If your return kit is lost in transit, we will reship a new kit at no additional cost and reschedule your Creation Date. If your kit is not returned within 60 days of shipment and we are unable to reach you, your order will be automatically cancelled and refunded minus the $50 kit fee.

Your completed kit is retained in physical, labeled storage under your name to maintain your fit for future orders. It is not digitized or shared with any third party. You may request its removal at any time by contacting client care.

08 · BOOKING

New to the Studio
All first-time clients must complete the Virtual Sculpting Kit process before their nail extensions can be handcrafted. Please select a Creation Date at least 3 weeks from the date of purchase. Creation Dates cannot be guaranteed until your sizes have been received.

Studio Guests
Once your sizes are on file, you may book any available date from the guest calendar. No kit is required. Please select a Creation Date at least 1 week from purchase.

Studio Members
Studio Members book exclusively through the Studio Members entrance using the priority calendar. Please select a Creation Date at least 1 week from purchase.

09 · CANCELLATION POLICY

Nail Extension Bookings
Booked slots may be cancelled up to 72 hours before your scheduled Creation Date at no charge. Cancellations requested after this window will not be accepted. Cancelling more than 2 nail set bookings within a 12-month period may result in the denial of future services at our discretion.

Non-Nail Extension Items
Orders for non-nail extension items may be cancelled within 12 hours of purchase. Cancellation requests submitted after this window will not be accepted.

We reserve the right to cancel or adjust any order at our discretion if we determine it may violate our policies, with or without prior notice.

10 · RESCHEDULING POLICY

A booked Creation Date may be rescheduled to a future available date provided the request is made at least 72 hours before the original Creation Date. Rescheduling requests made within 72 hours will not be accepted and the booking will be treated as a cancellation.

11 · NAIL SCHEDULE & ROTATION RESPONSIBILITY

Inglass Nails is a service studio. Ensuring you have a set of nail extensions ready for application by the end of your 4-week wear is entirely your responsibility as the client. We are not responsible for gaps in nail coverage resulting from late bookings, missed Creation Dates, or delayed renewal orders.

To maintain continuous nail coverage, we recommend the following rotation system: order two sets from scratch before relying on the renewal service; book your second set 2 to 3 weeks after your first set ships, ensuring it arrives before your 4-week removal date; and once you have two sets, send Set 1 for renewal immediately after removing it while you wear Set 2.

Booking and ordering renewal services in time to have nails ready by your 4-week removal date is entirely your responsibility. Extensions cannot be removed before the 4-week mark, except in the case of injury or an adverse reaction, as described in our Studio Policies. All extensions must remain bonded for the full 4-week wear period before removal under normal circumstances.

Premature lifting, allergic or adverse reactions, and natural nail injury are each addressed under their own dedicated policies in our full Studio Policies at inglassnails.com, which are incorporated into these Terms by reference.

12 · ORDER CHANGES

Once an order has been placed, we are unable to make modifications. However, changes to nail art details, shape, length, or color may be accommodated provided they do not result in additional charges or require a different Creation Date. Change requests must be submitted at least 24 hours before your booked slot.

We are not able to accommodate shape changes that disrupt the structural foundation of the extension, or length additions that require full sculpting from scratch. Length reductions may be requested during the renewal service.

13 · RETURNS, REFUNDS & EXCHANGES

Due to the fully custom, made-to-order nature of our nail extension sets, all nail extension sales are final. We do not accept returns or exchanges on nail extension orders. Returned or refused packages are not eligible for a refund.

This includes custom nail art orders, which are handcrafted based on your submitted reference and notes; satisfaction is based on accurate execution of the approved design rather than subjective preference after completion.

Damaged or incorrect items must be reported within 3 calendar days of delivery via email with a photo and description. Issues eligible for resolution include manufacturing defects and shipping damage. Cosmetic variations inherent to handmade products do not qualify as defects.

All other products may be returned unopened and unused within 30 days of receipt. Return shipping is the client's responsibility. Refunds are processed upon receipt and inspection.

14 · RENEWAL SERVICE POLICY & TURNAROUND

The renewal service requires no appointment. Renewals are processed in the order received. Standard turnaround is 3 business days from receipt of your set — not including transit time to or from your location.

Your set is eligible for renewal up to two times. Renewal will be declined if alternative adhesives were used, if extensions were removed with anything other than the official Inglass Nails Debonder, if signs of bacterial or fungal infection are present, if extensions are broken or structurally compromised without prior disclosure, or if unauthorized products or removal methods were used.

Premature lifting is addressed under a dedicated policy in our Studio Policies, including the circumstances under which free troubleshooting renewals are provided and the limits that apply.

Broken extensions must be sculpted from scratch and are not included in the renewal service fee. Disclose any broken or missing extensions before sending your set in. Replacement services are billed separately.

Submit your renewal order as soon as you remove your extensions. Early submission ensures your renewal is processed and returned during your second set's wear period.

15 · SHIPPING & DELIVERY

Inglass Nails ships exclusively within the United States. We do not ship internationally, to Puerto Rico, or to P.O. Boxes.

The Virtual Sculpting Kit ships via USPS in both directions. Nail extensions ship via UPS for the 48 contiguous states and via USPS Priority Mail for Alaska and Hawaii. Free standard shipping is available on orders over $55. Orders below $55 are subject to a $6.99 shipping fee. UPS Next Day Air is available at checkout for eligible orders. For orders exceeding $400, a signature upon delivery may be required at our discretion.

Except as otherwise stated, we are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. To the fullest extent permitted by applicable law, title and risk of loss pass to you when we transfer products to the carrier. We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier delays, natural disasters, severe weather, supply shortages, or other similar events. Carrier delays do not constitute grounds for cancellation, penalty, or compensation.

Inglass Nails is not responsible for packages marked as delivered to the address provided at checkout. Please double-check your shipping address before placing your order. Lost package claims must be reported after two weeks of no tracking movement. Approved claims are processed as product replacements only — no refunds or store credit.

16 · OPTIONAL TOOLS & THIRD-PARTY LINKS

You may be provided access to tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available," without warranties of any kind, and we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk.

The Services may also contain links to websites operated by third parties, including embedded third-party functionality (such as our booking and live chat platforms, described further below). We are not responsible for examining or evaluating third-party content, and if you choose to access third-party sites, you do so at your own risk. Complaints regarding third-party products or services should be directed to the third party.

17 · RELATIONSHIP WITH SHOPIFY

Inglass Nails is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify's systems. Any sales and purchases you make through our Site are made directly with Inglass Nails. Shopify is not responsible for any aspect of any sale between you and Inglass Nails, including any injury, damage, or loss resulting from our products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Inglass Nails.

18 · PRIVACY POLICY

Our Privacy Policy, available at inglassnails.com, explains how we collect, use, and disclose personal information from your use of the Services, and is incorporated into these Terms by reference. Because the Services are hosted by Shopify, Shopify also collects and processes certain information about your access to and use of the Services as you browse and interact with our Site, including transaction information, for purposes such as providing, securing, and improving the Services and preventing fraud. Please review both our Privacy Policy and Shopify's privacy policy for full detail on how your information is used.

Your Virtual Sculpting Kit, including your nail bed sizing information, is retained in physical, labeled storage identified by your name, solely to maintain your fit for future orders. This information is not digitized or shared with third parties. You may request removal of your stored kit at any time by contacting client care.

We do not knowingly collect information from individuals under the age of 18.

19 · USER REPRESENTATIONS

By using the Site, you represent and warrant that all information you submit is true, accurate, current, and complete; that you have the legal capacity and agree to comply with these Terms; that you are at least 18 years of age; that you will not access the Site through automated or non-human means except as expressly permitted under Section 21; that you will not use the Site for any unlawful purpose; that you are purchasing exclusively for personal use and not for professional, trade, or commercial purposes; that you are not a nail technician, beauty industry professional, or competitor accessing the Site to study or replicate our products or processes; and that you are the sole intended wearer of any extensions ordered under your account.

If any information you provide is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and refuse current or future use of the Site.

20 · PROHIBITED ACTIVITIES

You may access and use the Services for lawful purposes only. You may not use the Services for any unlawful or malicious purpose; to violate any applicable law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, or harm any person; to transmit false or misleading information; to send spam or unsolicited promotional material; to impersonate any other person or entity; or to engage in conduct that restricts or inhibits others' use of the Services or that we determine may harm Inglass Nails, Shopify, or other users.

You further agree not to upload viruses or malicious code; reproduce, duplicate, or exploit any portion of the Services without authorization; collect or track the personal information of others; access the Site as a nail technician, beauty professional, or industry competitor to study, replicate, or commercially reproduce our products, processes, bonding systems, or sculpting methods; systematically retrieve data or content from the Site without written permission; circumvent or interfere with security features of the Site; sell, transfer, or share your account or kit with another individual; or make improper use of our support services.

Initiating a chargeback or payment dispute for an order that has shipped, or for a kit that has been used, is a violation of these Terms. We reserve the right to contest such disputes using evidence including your signed Client Acknowledgment & Release, delivery confirmation, and order history, and clients who do so will be barred from placing future orders with Inglass Nails™.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you have violated any part of these Terms.

21 · AUTOMATED ACCESS & AI AGENTS

This section applies if you use, allow, enable, or cause the deployment of an "Agent" — any software or service that takes autonomous or semi-autonomous action on your behalf and can interact with our Services without your direct supervision — to access or interact with our Site.

No Agent may access, use, or interact with our Services unless it identifies itself as an Agent in all requests (including via the user agent string), does not conceal that its access is automated, does not mimic human behavior to circumvent bot-detection measures, responds truthfully to any prompt seeking to determine whether it is human or automated, and does not circumvent any measure intended to control Agent access. We may limit or block Agent access to our Services at our discretion, including by technical measures, at any time.

This section governs third-party automated tools or agents that may attempt to access our Site on your behalf. It is separate from and does not apply to our own customer-facing live chat, which is described in our Privacy Policy and uses AI to generate automated responses to client inquiries submitted directly through our Site.

22 · USER CONTRIBUTIONS & FEEDBACK

If you submit ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose, including commercial use. You represent that you own or have the rights to any Feedback you submit, that any compensation or incentive you received for it has been disclosed, and that it complies with these Terms. We are under no obligation to keep Feedback confidential, compensate you for it, or respond to it, and we may remove Feedback we determine to be unlawful, offensive, or otherwise objectionable.

As part of your first order, we request two photos — one after application and one after your first removal — for internal quality assessment purposes only. These are never used for marketing or shared publicly without your separate, explicit, opt-in consent, as described in our Privacy Policy.

23 · ERRORS, INACCURACIES & OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct such errors and to change, update, or cancel orders if information is found to be inaccurate, including after an order has been submitted. If we cancel an order after payment has been collected, we will issue any refund required by applicable law.

24 · TERMINATION

We may terminate this agreement or your access to the Services, in whole or in part, at our sole discretion at any time without notice, and you will remain liable for all amounts due up to the date of termination. Provisions that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Governing Law, and Privacy — will continue to apply.

25 · DISCLAIMER OF WARRANTIES

The information presented on the Services is made available for general informational purposes. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY INGLASS NAILS, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF CERTAIN WARRANTIES, SO THIS DISCLAIMER MAY NOT FULLY APPLY TO YOU.

26 · LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL INGLASS NAILS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY GOVERNED BY OUR CLIENT ACKNOWLEDGMENT & RELEASE WHERE APPLICABLE.

27 · INDEMNIFICATION

You agree to defend, indemnify, and hold Inglass Nails™ harmless — including our officers, agents, partners, employees, Shopify, and affiliates — from any loss, damage, liability, or claim, including reasonable attorneys' fees, arising out of your breach of these Terms; your violation of any law or third-party right, including intellectual property rights; your access to and use of the Services; or your use of our Site for professional, trade, or commercial purposes in violation of these Terms. We will notify you of any indemnifiable claim and may control its defense and settlement at your expense, though we will not settle any claim requiring non-monetary obligations from you without your consent.

28 · SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions. Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived by contract.

29 · WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right. These Terms, together with our Studio Policies, Client Acknowledgment & Release, and Privacy Policy, constitute the entire agreement between you and Inglass Nails and supersede any prior agreements or communications, whether oral or written.

30 · ASSIGNMENT

You may not delegate, transfer, or assign these Terms or any of your rights or obligations without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without notice to you.

31 · GOVERNING LAW

These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. You and Inglass Nails consent to the jurisdiction and venue of the courts located in Texas, except where prohibited by applicable law. Nothing in this section limits any rights you may have to bring claims in your local courts or rely on mandatory laws applicable in your place of residence.
